RATES

The sales prices of products on the www.montpellier4x4.com website are expressed in Euros and include all taxes. These prices do not include shipping costs, which will be calculated, according to the basket, at the time of order validation by the customer.

Any change in the VAT rate may be reflected in the price of products or services. www.montpellier4x4.com reserves the right to modify product prices at any time. The prices in force are those displayed at the time of the order.

Products remain the property of Montpellier 4x4 until full payment has been received by Montpellier 4x4.
For customers residing outside the EU or eligible for tax exemption, we can issue a tax exemption slip. The customer must contact us beforehand and provide us with all the information required to issue this slip.

ORDER

Any customer wishing to benefit from Montpellier 4x4 offers implies unreserved acceptance of these terms and conditions. To validate the order, the customer must :

- Proceed to payment by selecting a payment method
- Confirm payment

On receipt of a positive response from our banking services (in real time), Montpellier 4x4 will confirm the validation of the order on the www.montpellier4x4.com website immediately, and a summary e-mail will be sent to the customer. All data supplied will be recorded (except the customer's bank details) and will constitute proof of the sale.

PAYMENT

Montpellier 4x4 offers the customer several types of payment. The customer may choose to pay in full by :

Payment must be made when the order is placed. The total amount of the order will be cashed by Montpellier 4x4 when the order is validated. The order is final only after validation of payment and, in the case of an order of more than 4 items, an agreement from the management. Our banking services, in liaison with the customer's bank, will confirm in real time that payment has been made and that the order is therefore final. The goods sold remain the property of Montpellier 4x4 until full and unconditional payment of the corresponding debt. PRODUCT AVAILABILITY

Montpellier 4x4 is a retailer that does not sell in large quantities, which is why our company reserves the right to refuse orders for more than 3 units of the same product. Our products and prices are valid as long as they are visible on the site and while stocks last.

Montpellier 4x4 undertakes to inform the customer without delay if the product(s) ordered is (are) unavailable.


In this context, information on the availability of products is provided at the time of placing your order. As this information comes directly from our suppliers, errors or modifications may sometimes occur. If a product is unavailable, we will inform you by e-mail or post as soon as we receive the information. If you do not wish to wait and prefer to cancel your order, we will immediately refund your account if you have paid by credit card.

In the event of partial availability, Montpellier 4x4 will notify the customer by e-mail or telephone and may make a two-part delivery at the customer's request. Products in stock will be sent immediately and the remainder will be, as agreed with the customer by e-mail or telephone:

- Delivered at a later date with no charge for postage,
- Replaced by a similar item,
- Refunded.

This partial delivery option is only available for Metropolitan France. For other destinations, only a complete delivery will be made.

DELIVERY

Once the order has been confirmed, Montpellier 4x4 undertakes to dispatch the products ordered as quickly as possible. Montpellier 4x4 sends the customer an e-mail indicating that the order has been dispatched, with a summary of the customer's information and a tracking number (if the chosen carrier offers one). Customers can follow the progress of their order by connecting to the carrier's website.
It is important to differentiate between delivery times and shipping times. Montpellier 4x4 prepares and dispatches packages as soon as possible after order confirmation, if products are in stock. Delivery times are given for information only, as Montpellier 4x4 cannot be held responsible for any errors or delays by its carriers.


Delivery is made to the address indicated by the customer when creating the order in the "Delivery address" field. If the customer has not filled in this information, the order will be shipped to the customer's billing address. Shipping costs are automatically calculated according to weight, volume, type of merchandise and destination.

Montpellier 4x4 will choose the means of transport best suited to the order, depending on the type of product or its size. For shipments outside mainland France, the customer should contact Customer Service for a precise quote.

For shipments to countries outside the European Union, customs duties and taxes are the responsibility of the recipient customer.

RECEIPT OF ORDER

Montpellier 4x4 advises its customers to unpack and check the condition of the goods in the presence of the carrier. The risks associated with transport are borne by the customer who, in the event of problems noted on receipt, will make all the usual reservations with the carrier and will inform Montpellier 4x4 customer service within 72 hours.

In the event that the carrier presents a damaged product upon delivery, the customer may :
- Accept the package. In this case, the parcel will be considered as conform and no claim can be made. The words "subject to unpacking" cannot be taken into account in the event of a claim.
- Refuse delivery. In this case, we invite you to contact our services so that an advisor can examine your file and inform you of the procedure to follow.
On receipt of the product refused by the customer, Montpellier 4x4 will examine it to check whether the damage is real. In the event of damage, Montpellier 4x4 will exchange or refund the product.

RIGHT OF WITHDRAWAL

Customers have 14 days from the date of receipt of their order to return the product(s) ordered at their own expense.

Before returning the product, the customer must follow the following procedure:
- Provide the order number.
- Inform Montpellier 4x4 by e-mail and telephone of their intention to withdraw.
- Follow the withdrawal procedure as agreed with Montpellier 4x4.
- Return the product by registered mail with acknowledgement of receipt, or any other means at the customer's convenience, provided that the customer is assured of delivery tracking by the chosen carrier, indicating on the package the file number assigned by Montpellier 4x4 customer service.

Only this type of shipment will be accepted because, in the event of a dispute following the right of withdrawal, the customer must prove that the goods have been reshipped. This proof will only be valid on presentation of a registered delivery receipt issued by La Poste or the chosen carrier.

The returned product(s) must be returned complete, intact, in its (their) original packaging, and must not have been used.

Montpellier 4x4 can authorize itself to validate a return with a discount of 50 % minimum if the product(s) does (do) not return in a perfect state of origin and complete (s) (packing, accessories,...). Montpellier 4x' will send a letter with the reason for the discount.
Items returned incomplete, spoiled, used or damaged by the customer will not be refunded or exchanged.

Customers who have exercised their right of withdrawal may choose between :
- A full refund of the product (unless a discount is applied in accordance with the above rules)
- A voucher valid on www.montpellier4x4.com

In the event of retraction, Montpellier 4x4 undertakes to reimburse the purchaser for the product and shipping costs within a maximum of 14 days from the date of receipt of the goods by our logistics department.

DISPUTES

GUARANTEE

Any claim under the legal warranties provided for in articles L217-4 of the French Consumer Code and 1641 et seq. of the French Civil Code must be addressed to Montpellier 4x4, 8 Rue André Marie Ampère, ZA de la Clau, 34770 GIGEAN.

When acting under the legal warranty of conformity, the consumer :

- has a period of 2 years from delivery of the goods to take action,

- may choose between repair or replacement of the good, subject to the cost conditions stipulated in article L217-9 of the French Consumer Code,

- is exempted from proving the existence of the lack of conformity of the good during the six months following delivery of the good. This period is extended to twenty-four months from March 18, 2016, except for second-hand goods.

The legal warranty of conformity applies independently of any commercial warranty granted.
